**1. INTRODUCTION AND WHO WE ARE**

We sell handmade accessories, apparel, headwear, collectables and related goods ("Products") online to customers in South Africa and, where offered, internationally.
By browsing the Website, placing an order, or making a purchase, you agree to these Terms and Conditions ("Terms"). If you do not agree, please do not use the Website or place an order.

**3. PRODUCTS**
Products are largely handmade in small or limited runs. Colours, textures, sizing and finish may vary slightly from photographs. Product descriptions and images on the Website are for guidance; we take reasonable care to describe items accurately.
Stock is limited. Availability is shown on the Website where possible, but is only confirmed when your order is successfully placed and accepted. We may refuse or cancel an order if an item is unavailable, if there is a pricing or system error, or if we suspect fraud or abuse.
Some Products are fragile collectables (for example textile art pieces). Please handle and store them with care. Unless specified, our products are not meant as toys for children. Please keep out of reach of children. Our products may include small parts which could be dangerous to children.
**4. PRICES, CURRENCY AND VAT**
All prices are shown in South African Rand (ZAR) unless stated otherwise.
We are not registered for Value-Added Tax (VAT). Prices are final as shown and no VAT is added to your order.
VAT registration number: Not applicable.
Shipping costs for South African deliveries are shown at checkout. International shipping is quoted separately (see section 8).
We may change prices at any time, but changes will not affect orders already accepted.
**5. HOW TO PLACE AN ORDER**
The ordering process is: * Browse Products and add items to your cart. * Proceed to checkout and enter delivery, contact and payment details. * Review your order summary and total. * Submit your order ("Pay now" for South African delivery, or "Request shipping quote" for international delivery). * Complete payment where required (PayFast or EFT — see section 6). * Receive order confirmation and use the Order Status page to track payment and delivery progress.
You must provide accurate and complete information. You are responsible for ensuring your delivery address and contact details are correct.
Before you submit your order, you have an opportunity to review and correct your details on the checkout page.
**6. PAYMENT**
**6.1 Payment methods** We accept: * PayFast — secure online payment (including card payments processed by PayFast). * EFT / bank transfer to our nominated bank account.
**6.2 When payment is due** For South African orders, payment is due when you place your order (PayFast) or within the period stated on your order confirmation (EFT).
For international orders, payment is due only after we have sent you a shipping quote and you have accepted it, unless your order total is fully covered by a gift voucher (see section 9).
**6.3 Unpaid orders and expiry** If payment is not received within the applicable payment window, your order may be marked as expired and cancelled. Stock reserved for that order will be released. Current payment windows are configured as follows (and may be updated in our admin settings): * PayFast (pending payment): 1 hour from order placement. * PayFast (after a failed payment, retry window): 2 hours. * EFT South Africa (From when the order was placed): 72 hours from order placement. * EFT International (From when the shipping quote email is sent): 168 hours from the quote email.

**6.5 Payment security** Card and PayFast payments are processed by PayFast. We do not store your full card details on our servers. PayFast uses industry-standard security measures. For more information, see PayFast's website and security documentation.
**7. DELIVERY — SOUTH AFRICA**
**7.1 Courier and cost** South African orders are shipped using The Courier Guy at a flat rate shown at checkout (currently R 130, subject to change in admin settings).
**7.2 Processing and delivery time** We aim to process orders within 2 business days after payment is confirmed (or after order acceptance if paid by voucher). Delivery times depend on the courier and your location. These are estimates only, not guarantees.
**7.3 Risk and ownership** Risk in the Products passes to you on delivery to your nominated address.
**7.4 Failed delivery** If delivery fails because of incorrect address details you provided, we may charge you for re-delivery.
**8. DELIVERY — INTERNATIONAL**
**8.1 Shipping quote** For delivery outside South Africa, shipping is not calculated automatically at checkout. You request a shipping quote when placing your order. We will email you a quote for international shipping. Payment for the Products and shipping is due only after you accept the quote (unless fully covered by a gift voucher).
**8.2 Duties and taxes** International orders may be subject to import duties, taxes and customs clearance fees in the destination country. Unless we expressly agree otherwise in writing, these are your responsibility (delivery duty unpaid / DDU). We are not responsible for delays caused by customs.
**8.3 Quote expiry** Shipping quotes are valid for the payment period stated in the quote email. If you do not pay within that period, the order may expire and stock will be released.
**9. GIFT VOUCHERS**
**9.1 Purchasing a gift voucher** You may purchase a gift voucher for a chosen amount between R 100 and R 10 000 (cents allowed). After your order is paid, we issue a unique voucher code and send a PDF voucher by email to you the buyer and to the recipient details you provide.
**9.2 Redeeming a gift voucher** A voucher code may be used once per order. We apply up to the lesser of the voucher's remaining balance and your order total (including South African shipping where applicable). If your order total is less than the voucher's remaining balance, the unused balance stays on the same code and may be used on a later order on this Website, until the balance is used or the voucher expires under section 9.3.
**9.3 Voucher expiry** Vouchers expire 36 months from the date they are issued.
**9.4 Lost or stolen vouchers** Treat your voucher code like cash. We are not responsible for lost, stolen or unauthorised use of a code.
**9.5 Refunds on vouchers** Gift vouchers purchased on the Website are non-refundable and cannot be exchanged for cash, except in accordance with the 7-day cooling-off right under the ECT Act (Section 10.2), provided the unique voucher code has not yet been redeemed.
**10. CANCELLATION BY YOU**
This section is for customers who qualify as "consumers" under the Consumer Protection Act 68 of 2008 ("CPA") and the Electronic Communications and Transactions Act 25 of 2002 ("ECT Act"). If you buy for trade, business, or professional purposes, these rights may not apply.
**10.1 Cancelling before dispatch (CPA section 17)** Orders can be cancelled anytime before dispatch for a full refund, except for custom/made-to-order products.
**10.2 Cooling-off right (ECT Act section 44)** If you buy through this Website, section 44 of the ECT Act applies to your electronic transaction. You may cancel without reason and without penalty:
* for goods: within 7 days after the date on which you receive the goods. * for services: within 7 days after the date on which the agreement was concluded.
The only charge we may levy is the direct cost of returning goods to us. If you have already paid, you are entitled to a full refund of that payment, made within 30 days of your valid cancellation.
This cooling-off right does not apply where ECT Act section 42(2) excludes it. For our store, relevant exclusions may include: * goods made to your specifications or clearly personalised. * goods which by their nature cannot be returned or are likely to deteriorate or expire rapidly. * services that began with your consent before the end of the 7-day period.
Other statutory exclusions (for example financial services, auctions, or leisure services booked for a specific date) also apply as set out in the ECT Act.
If a transaction could also fall under CPA section 16 (direct marketing), CPA section 16(1) provides that section 16 does not apply where ECT Act section 44 applies. For purchases through this Website, the ECT Act 7-day cooling-off right applies.
**10.3 How to cancel** Email info@hannahreece.co.za with your order number and a clear request to cancel. Email is a recorded form of notice for these purposes.
If you are returning goods under your cooling-off right, return them unused, in their original condition, with proof of purchase, to the return address in section 12.2. Please contact us at info@hannahreece.co.za before dispatching a return so that we can facilitate the process efficiently. However, failure to contact us beforehand will not invalidate your statutory rights.
**11. CANCELLATION BY US**
We may cancel an order if: * a product is unavailable. * payment is not received within the applicable payment window. * we decline an international shipping request. * we suspect fraud, error or abuse. * we are required to do so by law.
If we cancel after you have paid, we will refund you in full within 30 days, unless the law allows otherwise.
**12. RETURNS, EXCHANGES AND DEFECTIVE GOODS**
**12.1 Defective or damaged goods (Consumer Protection Act)** Nothing in these Terms limits your statutory rights. If Products are defective, unsafe or not of good quality, you have the right to return them within 6 months for repair, replacement or refund, as provided by the Consumer Protection Act. **13. PRIVACY AND PERSONAL INFORMATION**
We collect personal information when you place an order, subscribe to marketing, or contact us (for example: name, email, phone, delivery address, order history).

**14. INTELLECTUAL PROPERTY**
All content on the Website (text, images, logos, designs, layout) is owned by us or our licensors and is protected by copyright and other laws. You may not copy, reproduce or use it without our written permission.
Designer brand names and logos shown on Products belong to their respective owners.
**15. LIMITATION OF LIABILITY**
To the fullest extent permitted by law, we are not liable for indirect or consequential loss. Our total liability for any claim relating to an order is limited to the amount you paid for that order.
Nothing in these Terms excludes or limits liability that cannot be excluded under the Consumer Protection Act or other applicable law (including liability for gross negligence or defective goods).
We are not responsible for courier delays, customs delays, or events outside our reasonable control (force majeure).
**16. GOVERNING LAW AND DISPUTES**
These Terms are governed by the laws of the Republic of South Africa.
You consent to the jurisdiction of the Magistrate's Court in George, Western Cape for disputes, subject to your rights under the Consumer Protection Act to refer complaints to the National Consumer Commission or Consumer Goods and Services Ombud where applicable.
**17. CHANGES TO THESE TERMS**
We may update these Terms from time to time. The "Last updated" date at the top will change when we do. Continued use of the Website after changes constitutes acceptance. Material changes affecting existing orders will be handled fairly and in accordance with law.
**18. GENERAL**
If any part of these Terms is invalid, the rest remains in force. Failure to enforce a right does not waive it. You may not assign your rights under an order without our consent.
